La reparación simbólica en la Justicia Transicional

Abstract

Spa:La ponencia parte de la justicia retributiva en donde la reparación simbólica surge como una respuesta y medio para reparar la grave y sistemática transgresión a los derechos humanos, pasando por la importancia de las víctimas, que son el foco principal, en donde la justicia, verdad, reparación y garantías de no repetición son pilares fundamentales. Teniendo en cuenta la importancia de las víctimas en este proceso, se tiene la reparación simbólica como una herramienta indispensable para lograr la un resarcimiento en el marco de una justicia transicional y retributiva. Se menciona la relación entre reparación simbólica y el derecho, y como ésta es necesaria para contar e interpretar sucesos históricos que hacen parte hoy día de la realidad de un país salido de un conflicto armado interno de más de 50 años, y que actualmente atraviesa por un periodo que ha sido denominado por muchos como posconflicto.

The relationship between symbolic reparation and law is mentioned, and how it is necessary to recount and interpret historical events that are now part of the reality of a country that has emerged from an internal armed conflict of more than 50 years, and is currently going through a period that has been referred to by many as post-conflict.
