Las formas de reparación en la justicia transicional

Abstract

Spa: La ponencia parte del conflicto armado que en países como el nuestro ha estado presente durante muchos años y por consiguiente es necesario buscar mecanismos que contribuyan a generar transformaciones estructurales de manera que, al final del proceso las personas que estuvieron involucradas en el conflicto sea víctimas o victimarios puedan vivir en paz y compartir los mismos espacios, generando una transformación social y política profunda para resolver los problemas derivados de un pasado de abusos a gran escala; con lo anterior encontramos la justicia transicional que podemos explicar como una receta que tiene ingredientes de justicia pero también incluye ingredientes de búsqueda de la verdad y un ingrediente importante de reparación y con ésta se busca que se pueda lograr tránsito hacia la paz y que esta situación de paz perdure en el tiempo para que no haya una repetición a las violaciones graves de derechos humanos. En la presente ponencia se tiene dos momentos claves, el primero donde se resalta la importancia de la justicia restaurativa en la justicia transicional, pues se determinan unos pasos importantes hacia una justicia transformadora ya que las víctimas están regresando al centro del debate, recupera el rol protagónico, pues su participación en el proceso es esencial para detener la violencia que destruye el tejido social, y diseñando programas de prevención del delito por medio de la inclusión social y de respuestas que buscan diálogo entre infractor y víctima rompiendo el ciclo de odio. Finalmente el otro momento clave es la importancia de las garantías de No repetición que se encargan de construir los lazos de reconciliación, evitar el surgimiento de nuevos actores armados, siendo así la No repetición fundamental en un país como el nuestro que lleva 50 años de conflicto con un grupo armado, transformar las condiciones de tipo político, económico, social y cultural que propiciaron las vulneraciones a los Derechos Humanos y las infracciones al Derecho Internacional Humanitario.

Eng: The paper starts from the armed conflict that in countries like ours has been present for many years and therefore it is necessary to seek mechanisms that contribute to generate structural transformations so that at the end of the process the people who were involved in the conflict whether victims or perpetrators can live in peace and share the same spaces, generating a deep social and political transformation to solve the problems arising from a past of abuses on a large scale, With the above we find transitional justice that we can explain as a recipe that has ingredients of justice but also includes ingredients of truth-seeking and an important ingredient of reparation and with this is seeks to achieve transit to peace and that this situation of peace lasts over time so that there is no repetition of serious violations of human rights. In this paper there are two key moments, the first one where the importance of restorative justice in transitional justice is highlighted, as important steps towards a transformative justice are determined, since the victims are returning to the center of the debate, recovering the leading role, as their participation in the process is essential to stop the violence that destroys the social fabric, and designing crime prevention programs through social inclusion and responses that seek dialogue between offender and victim, breaking the cycle of hatred. Finally, the other key moment is the importance of the guarantees of non-repetition, which are responsible for building the bonds of reconciliation, preventing the emergence of new armed actors, thus being the non-repetition fundamental in a country like ours that has 50 years of conflict with an armed group, transforming the political, economic, social and cultural conditions that led to the violations of Human Rights and breaches of International Humanitarian Law.
